By subscribing to or using the Monthly Wash Club (the “Program”), you (“Subscriber,” “you,” or “your”) agree to be legally bound by these Terms of Service (“Terms”). These Terms govern your subscription with Suncoast Car Wash SA LLC and its affiliates (collectively, “Suncoast Car Wash,” “we,” “us,” or “our”). Please read these Terms carefully. They contain important limitations on liability, a binding arbitration agreement, and a class action waiver.
• The Program provides up to ten (10) washes per calendar month at participating locations during normal operating hours, solely for the single vehicle registered to your Subscription.
• Washes are available only when the facility is open to the general public. We reserve the right to close for holidays, maintenance, weather, utility interruptions, government orders, or any other reason without providing credits, refunds, or extensions.
• Subscriptions are non-transferable between persons, vehicles, or locations. Only the exact vehicle (by VIN/license plate) registered at the time of enrollment qualifies.
• You must promptly update your vehicle, contact, and payment information. Failure to do so may result in suspension or termination of your Subscription.
By enrolling, you expressly consent to our use of Automated License Plate Recognition technology and any other monitoring systems to verify your enrollment and usage.
• All pricing is subject to change at any time. Current rates are posted at the location and/or on our website.
• Personal-Use Vehicles: Diamond Club, Gold Club, or Silver Club pricing applies.
• Family Plan: Available only for Diamond Club on up to four additional personal-use vehicles under the same payment method. Additional vehicles receive a 10% discount. Commercial vehicles are ineligible. Removing vehicles may cause your plan to revert to standard single-vehicle pricing.
• Commercial Vehicles: $49.99/month (or current commercial rate) with no Family Plan. We define commercial vehicles broadly to include any vehicle with commercial plates, GVWR over 7,500 lbs, DOT registration, ride-share/taxi/livery use, fleet use, commercial markings, or any vehicle we reasonably determine is used commercially.
• We may reclassify your vehicle and adjust pricing or terminate your Subscription if it does not qualify for the selected tier. You waive any right to appeal such determinations.
• You authorize recurring monthly charges to your designated payment method on the Renewal Date (the day you originally subscribed, subject to calendar adjustments).
• Billing continues automatically regardless of actual usage. There are no refunds or credits for partial months, unused washes, or closures.
• Cancellation must be received at least five (5) days before your Renewal Date via phone, email, in person, or online portal. Cancellation takes effect at the end of the current subscription period.
• Failed payments: We may attempt collection for up to 30 days. Until payment is received, we may suspend or terminate your Subscription. Reinstatement is retroactive to the most recent Renewal Date.
• You may not combine the Program with other discounts or promotions.
All provisions of our Terms of Use (including the full liability waiver and damage disclaimers) are incorporated herein by reference and apply to every visit under the Program.
You remain fully responsible for:
• Verifying vehicle height (maximum 7 feet), removing/retracting all prohibited items, and ensuring the vehicle is safe for the tunnel
• Any damage to your vehicle or our equipment caused by your driving, braking, or vehicle condition
• Pre-existing damage that is worsened by the wash
You must report any issue before leaving the premises. Failure to do so waives all claims.
THE PROGRAM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH NO WARRANTIES, express or implied.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Suncoast Car Wash, its owners, officers, directors, employees, agents, and affiliates shall not be liable for any damages whatsoever, including but not limited to:
• Direct, indirect, incidental, consequential, special, punitive, or exemplary damages
• Vehicle damage of any kind (including those listed in the Terms of Use)
• Personal injury
• Loss of use, revenue, or profits
Our total liability to you shall not exceed the amount of Subscription fees you paid in the one (1) month preceding the claim.
You agree to defend, indemnify, and hold harmless Suncoast Car Wash and all Released Parties from any and all claims, losses, liabilities, damages, costs, and expenses (including attorneys’ fees) arising from:
• Your breach of these Terms
• Your use or misuse of the Program
• Any damage caused by your vehicle
• Any violation of law
We may immediately suspend or terminate your Subscription, without notice or refund, if:
• You violate these Terms
• You attempt to misuse the Program
• Payment fails
• We determine, in our sole discretion, that termination is necessary
Any dispute arising out of or relating to these Terms, your Subscription, or your use of the Program (including formation, interpretation, or enforceability of this arbitration agreement) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
• You waive any right to a jury trial or to participate in any class, representative, or consolidated action
• Arbitration must be initiated within one (1) year of when the claim accrues
• The place of arbitration shall be Lake County, Florida
• The Federal Arbitration Act governs this agreement
• Small claims court option is preserved for qualifying individual claims only
• The arbitrator may not award punitive or consequential damages or conduct class proceedings
You may opt out of arbitration within 30 days of first subscribing by sending written notice to our legal department. Opting out does not affect other provisions.
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. Any court proceedings (if arbitration is inapplicable) shall be brought exclusively in the state or federal courts located in Broward County, Florida. You consent to personal jurisdiction in those courts and waive any inconvenient forum defense. You also waive any right to a jury trial in any court proceeding.
• Changes: We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be posted at the location
• Severability: If any provision is invalid, the remainder remains in effect
• Survival: Sections regarding liability, indemnification, arbitration, and governing law survive termination
• Entire Agreement: These Terms (together with the Terms of Use) constitute the entire agreement
• Assignment: We may assign these Terms without notice
• No Waiver: Our failure to enforce any right does not waive it
By subscribing to or using the Program, you acknowledge that you have read, understood, and agree to these Terms, including the broad liability limitations, indemnification obligations, and binding arbitration agreement.
