• Height Restriction: The maximum tunnel clearance is seven (7) feet (84 inches), measured from the ground to the highest point of the vehicle, including any cargo, racks, antennas, or accessories. Vehicles exceeding this height, or any items that could exceed it, are strictly prohibited from entering the tunnel. The Driver is solely responsible for verifying clearance and for any and all damage caused by non-compliance.
• Vehicle Condition: Vehicles must be in safe operating condition. We reserve the right to refuse service to any vehicle that, in our sole discretion, poses a safety risk or is likely to cause damage to our equipment or other vehicles.
• Truck Beds and Accessories: Truck beds must be completely empty and free of all debris, tools, straps, or loose items. All bike racks, trailer hitches, auxiliary fuel tanks, brush guards, winches, light bars, utility racks, pipe racks, and similar aftermarket additions must be removed or retracted prior to entry. Failure to comply may result in service denial or equipment retraction at your expense.
• Immediate Reporting: All damage, scratches, dents, or issues must be reported to Carwash staff before leaving the premises. Failure to report constitutes a waiver of any claim against the Carwash.
• Driver Liability: You are fully responsible for any collisions, contact, or damage occurring inside the tunnel, on the premises, or while operating your vehicle in any Carwash area. This includes damage caused by braking, acceleration, steering errors, or vehicle malfunction.
• Pre-Existing Conditions: You are responsible for any further damage or escalation of pre-existing conditions, including (but not limited to) glass chips, cracks, leaks, loose parts, or worn components.
IN NO EVENT SHALL THE CARWASH, ITS OWNERS, AFFILIATES, SUBSIDIARIES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SUCCESSORS (COLLECTIVELY, “RELEASED PARTIES”) BE LIABLE — WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE — FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE CARWASH FACILITY.
This waiver specifically includes, without limitation, any damage to:
• Glass (chips, cracks, breakage, or water leaks)
• Wiper blades, arms, or related components
• Antennas (fixed, powered, shark-fin, or otherwise)
• Luggage racks, ski racks, spoilers, or roof accessories
• Loose chrome, molding, trim, emblems, or substandard/aftermarket parts
• Non-factory-installed items
• Mirrors, sunroofs, spare tire covers, bug shields, wind/rain deflectors
• Running boards, wheel covers, pinstriping, decals, wraps, body molding
• Repainted vehicles, vehicles over 7 years old, or vehicles with non-standard modifications
• Any other exterior or interior component vulnerable to brushes, water, chemicals, or high-pressure systems
The Carwash provides service AS IS with NO WARRANTIES, express or implied, including any warranty of merchantability or fitness for a particular purpose. Wash quality and results cannot be guaranteed, especially for vehicles with aftermarket modifications, older paint, or non-standard features.
We reserve the absolute right to retract, disable, or adjust our equipment (including brushes, high-pressure jets, and drying systems) for any vehicle equipped with items that may interfere with operations, such as brush guards, winches, light bars, utility racks, unemptied truck beds, or any other protrusions. You remain fully liable for any damage resulting from such vehicles.
• Individuals with photosensitivity, claustrophobia, respiratory conditions, or any other medical sensitivity to bright lights, enclosed spaces, chemicals, or noise should consult staff before entering. The Carwash may offer accommodations where possible but assumes no liability for any discomfort or health effects.
• You assume all risk of personal injury while on the premises, including while in or near vehicles in the tunnel.
You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:
• Your violation of these Terms
• Damage to your vehicle or other property
• Damage to Carwash equipment or facilities
• Injury to you, your passengers, or third parties caused by your vehicle or actions
• Governing Law: These Terms shall be governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Broward County, Florida.
• Severability: If any provision is held invalid, the remainder shall continue in full force.
• Entire Agreement: These Terms constitute the entire agreement between you and the Carwash regarding use of the facility and supersede all prior understandings.
• Right to Refuse Service: We reserve the right to refuse service to anyone for any reason at any time.
• Amendments: The Carwash may update these Terms at any time. Continued use after changes constitutes acceptance.
By proceeding through the Carwash, you acknowledge that you have read, understood, and voluntarily agree to these Terms of Use, including the broad waiver of liability and assumption of risk. You further certify that you are the owner or authorized operator of the vehicle and have full authority to bind the vehicle owner to these terms.
